Terms of Service

These Terms of Service ("Terms") govern the use of the eSIM.tech website, reseller platform, and API (together, the "Services"), operated by eSIM Tech B.V., Tol 2, 4267ES Drongelen, the Netherlands, KvK 97135313 ("eSIM.tech", "we", "us"). By creating an account or using the Services, you agree to these Terms.

1. The Services

eSIM.tech provides an API-first platform through which business customers ("Resellers") can provision, manage, and resell eSIM-based mobile connectivity, including pay-as-you-go data, local eSIMs with phone numbers, EU data bundles, and related products. The underlying connectivity is delivered over networks of licensed mobile network operators.

2. Accounts and eligibility

  • The Services are intended for business use. By registering, you confirm you act in the course of a business, not as a consumer.
  • You are responsible for keeping your API keys and credentials confidential and for all activity under your account.
  • You must provide accurate company and billing information and keep it up to date.

3. Fees and billing

  • Unless agreed otherwise in writing, there are no minimum purchase obligations: you pay for the eSIMs, bundles, and usage you provision, at the wholesale prices shown in the reseller portal.
  • Prices may change; changes apply to new provisioning, not retroactively.
  • Invoices are payable within the term stated on the invoice. We may suspend provisioning for accounts with overdue balances.
  • All prices are exclusive of VAT unless stated otherwise.

4. Reseller responsibilities

  • You set your own retail prices and are solely responsible for your relationship with your end customers, including support, refunds, and consumer-law compliance in the markets where you sell.
  • You must comply with applicable laws, including telecom regulations, sanctions, and export controls, and any registration or identification requirements that apply to eSIMs with phone numbers in specific countries.
  • You may white-label the Services under your own brand, but you may not misrepresent the origin of the connectivity or claim to be a mobile network operator where you are not.

5. Acceptable use

You may not use the Services, and must ensure your end customers do not use them, for unlawful purposes, including fraud, spam or unsolicited bulk communications, network abuse, circumvention of legal interception or registration requirements, or any activity that threatens the integrity of the underlying networks. We may suspend or terminate eSIMs or accounts involved in abuse.

6. Service levels and availability

  • We operate the platform with a target uptime of 99.9% and provision eSIMs on a best-effort, near-real-time basis.
  • Mobile coverage, speeds, and availability depend on third-party networks and local conditions and are not guaranteed.
  • Planned maintenance is announced in advance where reasonably possible.

7. Intellectual property

We retain all rights to the platform, API, documentation, and branding. You receive a non-exclusive, non-transferable licence to use the API and documentation for the purpose of reselling the Services during the term of your account.

8. Data protection

Each party complies with applicable data protection law. Where we process personal data of your end customers on your behalf, our Privacy Policy applies and a data processing agreement is available on request.

9. Liability

  • To the maximum extent permitted by law, our total liability arising out of or in connection with the Services in any 12-month period is limited to the amounts you paid to us for the Services in that period.
  • We are not liable for indirect or consequential damages, including lost profits, lost revenue, or claims from your end customers.
  • Nothing in these Terms limits liability for intent or gross negligence.

10. Term and termination

  • Either party may terminate the account at any time; provisioned eSIMs and unpaid fees survive termination.
  • We may suspend or terminate the Services immediately in case of material breach, abuse, or where required by operators or authorities.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced by email or in the reseller portal at least 30 days before they take effect. Continued use of the Services after that date constitutes acceptance.

12. Governing law and disputes

These Terms are governed by Dutch law. Disputes will be submitted exclusively to the competent court in the Netherlands, unless mandatory law provides otherwise.
